Our Errors and Omissions Insurance applications seek to obtain information that will allow the underwriter to understand your real estate business and for us to recommend the appropriate real estate E&O policy for you. The attached applications are a warranty applications. Specifically, this means that the insurance carrier will rely upon the statements made therein to make decisions concerning claims, policy interpretation, etc.
It is important that, prior to signing, you take a moment to confer with your management team and make certain than any significant changes in your company have been reported, all revenues/premium volumes are accurate, and most importantly that any known or suspected claims are fully disclosed. All known claims or incidents that you believe might give rise to a claim must be reported to the current insurance carrier as soon as possible as outlined in your current policy.
In the tightening market we have now seen carriers look harder than ever before at what should be reported on an application for insurance when reviewing claims. Sadly, we have seen claims denied due to omissions on applications or a failure to report claims when required.
